1About These Terms

These Terms of Service ("Terms") govern your use of the Nurse Aid Australia website at nurseaidaustralia.com.au ("website"), operated by Nurse Aid Australia Pty Ltd ("Nurse Aid Australia", "we", "us", "our").

By accessing or using this website, you agree to these Terms. If you do not agree, please do not use this website.

These Terms apply to website visitors, referrers, families, job applicants, and anyone else who accesses this website. They do not replace or modify the terms of any NDIS service agreement entered into between Nurse Aid Australia and an NDIS participant — those agreements are governed by separate written contracts and the NDIS Act 2013.

We may update these Terms from time to time. The current version will always be available on this page with the effective date shown above. Continued use of the website after an update constitutes acceptance of the revised Terms.

2Website Use

You may use this website for lawful purposes only. You must not:

  • Use the website in any way that breaches any applicable law or regulation

4Referral Submissions

When you submit a referral through our website, you confirm that:

  • You have the authority to make the referral on behalf of the participant or your organisation
  • The information you provide is accurate to the best of your knowledge
  • You have obtained any consent required to share the participant's information with Nurse Aid Australia for the purpose of assessing the referral
  • You understand that submitting a referral does not constitute an agreement to provide services — services are confirmed separately through a written service agreement

Referral submissions are subject to our Privacy Policy. We handle participant information submitted in referrals in accordance with the Australian Privacy Act 1988 and the NDIS Practice Standards.

We will respond to referral submissions within one business day. Receipt of a referral does not guarantee placement — all referrals are subject to clinical assessment and capacity confirmation.

5NDIS Service Agreements

The provision of NDIS support services by Nurse Aid Australia is governed by a written NDIS Service Agreement entered into with each participant (and their nominee, plan manager, or guardian where applicable). These Terms do not form part of that service agreement.

NDIS Service Agreements are prepared in accordance with:

  • The NDIS Act 2013 and associated rules
  • The NDIS Practice Standards and Quality Indicators
  • The NDIS Pricing Arrangements and Price Limits (current version)
  • Relevant state legislation including the Disability Inclusion Act 2018 (SA)

Participants and their nominees have the right to request a copy of the service agreement before signing, to negotiate its terms, and to exit the agreement with reasonable notice in accordance with the NDIS framework. We actively support participant choice and control.

Service fees are charged in accordance with the NDIS Pricing Arrangements and Price Limits. We do not charge fees that exceed the applicable price limits without prior written agreement.

6Our Obligations

As a registered NDIS provider, Nurse Aid Australia is obligated to:

  • Deliver supports in accordance with the NDIS Practice Standards and Quality Indicators
  • Comply with the NDIS Code of Conduct
  • Report notifiable incidents to the NDIS Quality and Safeguards Commission within required timeframes
  • Maintain a complaints management system and actively support participants' right to make complaints
  • Protect the privacy of participant information in accordance with the Australian Privacy Act 1988
  • Employ or engage only workers who have completed required NDIS Worker Screening checks
  • Deliver high intensity daily personal activities only through staff trained and assessed against the NDIS High Intensity Support Skills Descriptors

These obligations exist independently of these Terms and are enforceable by the NDIS Commission.

7Your Obligations

When interacting with Nurse Aid Australia — whether through this website, referral submissions, or as a participant, family member, or support coordinator — you agree to:

  • Provide accurate and complete information when submitting referrals or enquiries
  • Notify us promptly if information you have provided changes in a material way
  • Treat Nurse Aid Australia staff with respect
  • Not misrepresent your relationship to any NDIS participant
  • Use any documentation or information provided by Nurse Aid Australia only for its intended purpose

Participants receiving services from Nurse Aid Australia have additional obligations set out in their individual service agreements, including providing reasonable notice of service changes and cooperating with the development and review of care plans.

8Liability

To the extent permitted by law, Nurse Aid Australia excludes all warranties in relation to this website and its content, including warranties of accuracy, completeness, fitness for purpose, and non-infringement.

Nurse Aid Australia's liability for any loss or damage arising from use of this website — including indirect, consequential, or economic loss — is excluded to the maximum extent permitted by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).

Nothing in these Terms excludes, restricts, or modifies any right or remedy you may have under the Australian Consumer Law that cannot be excluded by agreement.

Liability arising from the delivery of NDIS support services is governed by the relevant service agreement and applicable law — not by these website Terms.

9Intellectual Property

All content on this website — including the Nurse Aid Australia name, logo, clinical governance framework descriptions, service descriptions, and all written material — is the intellectual property of Nurse Aid Australia Pty Ltd or is used under licence.
